New Delhi – In a significant move aimed at reinforcing accountability and good governance in Jammu & Kashmir, Union Home Minister Amit Shah has introduced the Jammu & Kashmir Reorganisation (Amendment) Bill, 2025 in the Lok Sabha. This pivotal legislation stipulates the removal of Chief Ministers and Ministers from their positions if they are held in custody for more than 30 days on serious criminal charges.

The Bill addresses a crucial legal gap within the region’s political framework and establishes clear measures to uphold constitutional morality. It emphasizes that if a Minister or Chief Minister is detained on charges punishable by five years or more, they will automatically be removed from office after the 30-day threshold.

Key provisions of the Bill include the role of the Lieutenant Governor, who will act based on the Chief Minister’s advice regarding the removal of a Minister. Should the Chief Minister fail to provide advice by the 31st day of custody, the Minister will automatically cease to hold office. In instances where the Chief Minister is in custody themselves for over 30 days, they are required to resign; if they do not, they will be removed from their position without question.

Moreover, the Bill permits reappointment of the affected officials once they are released from custody, allowing for the possibility of a return to public service after due process.

This groundbreaking legislation is anticipated to reshape the political landscape of J&K, instilling renewed faith in governance and ensuring that leaders adhere to the highest standards of conduct.
